Terms & Conditions

This document sets out the terms governing the Tribes service ("Tribes"). Together with our pricing page and any booking and cancellation policy that applies to the stay you choose, it forms a legal agreement (the "Agreement") between you, the user of Tribes, and us, Artem Peregoudov, operating under the trade name "Tribes" (Bogis-Bossey, Switzerland; chief@tribes.travel). "Tribes" is a trade name and not a registered company.

1. What Tribes lets you do.

Tribes lets you discover, select and book a curated selection of family-friendly accommodation provided by Nuitée Travel Limited ("Nuitée") through the Tribes website. Throughout these Terms we call such a booking a "Stay". These Terms govern every Stay booked through Tribes; you must comply with them whenever you book.

2. Who provides your Stay — and our role.

Tribes provides the selection and booking interface and related support. The Stay itself — the travel service and the booking — is provided by Nuitée Travel Limited, which also acts as merchant of record and processes the payment; the accommodation is delivered by the relevant hotel or host. Tribes is not the seller or provider of the travel services, is not a party to the booking/travel contract, and does not process payments or hold your funds. Your booking contract is formed with Nuitée and/or the accommodation provider.

3. The terms that also apply.

As a user of Tribes you must also comply with the conditions and with any booking and cancellation policy that applies to the Stay you choose. In most cases this means you must comply with Nuitée's Terms & Conditions (nuitee.com/terms-and-conditions). For every Stay you must in addition comply with the booking and cancellation policy of that Stay, shown to you before you book. Where these differ regarding the travel service, Nuitée's terms and the Stay's policy prevail for that service. You confirm you have read them.

4. Booking a Stay.

The booking steps are shown before you confirm. Once you confirm, Nuitée transmits your information to the relevant accommodation provider to confirm your Stay, and you receive a confirmation email from Nuitée once the Stay is confirmed. You are responsible for checking that all details (names exactly as on ID, dates, city/country, occupancy) are correct.

5. Prices & payment.

Prices appear in CHF and, unless stated, include applicable direct taxes; local, tourist or city taxes and incidental hotel charges may be payable on site. Payment is collected and processed by Nuitée Travel Limited, and the transaction appears as "Nuitée Travel Limited" on your statement, to help you link the payment to your booking. Tribes neither receives, processes nor stores card data.

6. Cancellations, refunds & changes — what Tribes does not control.

The booking and cancellation policy of each Stay explains what happens if you cancel and varies from one provider to another. Tribes exercises no control over the booking, cancellation or amendment policy of a Stay, nor over whether Nuitée or the provider approves a change you request. You must review the essential policy information shown when you select the Stay (free-cancellation period, if any, and the consequences of cancelling). Where a refund is due, it is handled by Nuitée as merchant of record. To change dates, room or number of guests, the relevant Stay decides how the change is handled; Nuitée confirms to us whether the Stay accepts it, and you may have to pay more if the new price is higher or fees apply.

7. If your Stay becomes unavailable.

If the provider can no longer honour your booking, our support will try to help you find a replacement of a similar standard. If you accept a replacement we will update your booking. If no suitable replacement is found and you choose to cancel, you will receive a refund (handled by Nuitée), even if this occurs outside the free-cancellation period. Tribes accepts no liability for losses or costs arising from relocation, which is beyond our control.

8. Your warranties.

By booking accommodation through Tribes, you promise that the information you provide to make your booking is true and correct, that all guests meet the requirements of the booking (including any travel documents, age or occupancy rules), and that you are at least 18 and able to enter a binding contract.

9. Accuracy of curated and generated content — indicative only.

Tribes curates, compiles and generates family-travel information, including family-amenity and "family-friendly" assessments, kids-club checks, "verified"/"checked"/confidence indicators and source labels, destination and area guides, descriptions, photographs, ratings, scores and recommendations (together, "Tribes Content"). All Tribes Content is provided for general guidance and is indicative only. It is compiled from information supplied by hotels, hosts and third parties and from our own review at a given point in time; facilities, services, kids clubs, age ranges, opening periods, prices and conditions change frequently, may be seasonal, may require advance booking, may carry extra fees, and may differ from what is shown. A "verified", "checked" or confidence indicator means only that we carried out a reasonable, good-faith check against the sources available at the date shown — it is not a guarantee, warranty or promise that any feature, service or kids club is present, available, open, suitable, safe or as described during your stay. You are responsible for confirming anything that matters to your decision — in particular kids clubs, child age rules, safety, accessibility and specific amenities — directly with the accommodation provider before booking and again before travel. To the maximum extent permitted by law, Tribes accepts no responsibility or liability for any inaccuracy, omission, change, unavailability or out-of-date information in Tribes Content, or for any decision, booking or reliance you place on it. Mandatory consumer-protection rights that cannot be excluded by law remain unaffected.

10. Limitation of Tribes' liability.

Tribes provides only the curation/interface, the content described above, and related support, with reasonable care. Tribes does not perform travel services and gives no warranty as to the accommodation, the provider, or Nuitée. To the maximum extent permitted by law, Tribes excludes all liability for: the accuracy or completeness of Tribes Content; the performance, quality, availability, cancellation or non-provision of any travel service; illness, personal injury, theft, loss or damage arising from a Stay; the accuracy of hotel descriptions, photos, star ratings or maps (provided by third parties); payment processing, chargebacks, refunds, currency or transaction fees; relocation; and any indirect or consequential loss. Any claim relating to a booking, payment or Stay must be directed to Nuitée Travel Limited and/or the accommodation provider, who are responsible for the travel services and payment. If any liability of Tribes is nonetheless established, it is limited to the curation/service fee (if any) Tribes received for the booking. Mandatory consumer-protection rights that cannot be excluded by law remain unaffected, and nothing here excludes liability for Tribes' own intent or gross negligence.

11. Force majeure.

Neither Tribes nor the provider is liable where performance is prevented or affected by events beyond reasonable control, including war, civil unrest, terrorism, strikes, natural or nuclear disaster, adverse weather, epidemics, fire and similar events.

12. Authorisation to process your personal data.

When you book, we ask for the information needed to confirm the booking (e.g. first and last name, date of birth, nationality, phone, email, billing address, and the age of any child travelling). We process this data and share it with Nuitée so your booking can be confirmed; Nuitée in turn transmits it to the chosen accommodation provider. Tribes does not collect or share card data — payment data is provided directly to Nuitée as merchant of record. Tribes and Nuitée act as independent data controllers. We process your data under the Swiss nFADP and, where applicable, the EU GDPR; see our Privacy Policy.

13. Complaints & what Tribes can help with.

If you are dissatisfied with the Tribes service (whether or not you booked a Stay), contact chief@tribes.travel and tell us you wish to make a complaint; we will review it and reply by email as soon as possible. A complaint about the Tribes service is made against Artem Peregoudov (Tribes) as provider of that service. Tribes can only handle complaints relating to the service we provide, namely: the selection and booking process; helping you find a replacement if your Stay becomes unavailable; passing your information to Nuitée to confirm or change a booking; and relaying to Nuitée, on your behalf, a complaint you raise about your Stay. For the Stay itself, payment, invoicing, refunds and cancellations, Nuitée Travel Limited (and/or the accommodation provider) is the responsible party — we will redirect you to them where appropriate.

14. Intellectual property.

The Tribes name, content, curation and design are protected and may not be reused without written permission.

15. Changes to these Terms.

We reserve the right to change these Terms at any time and will do our best to notify you in advance; the version in force at the time of your booking applies.

16. Governing law, jurisdiction & enforcement.

These Tribes Conditions are governed by Swiss law. You may nonetheless always rely on the mandatory consumer-protection rules of your country of residence. Legal action against Tribes may be brought before the competent courts of the Canton of Vaud, Switzerland; if you reside elsewhere you may have the right to bring action before the courts of your country of residence. For any claim against Nuitée Travel Limited regarding the Stay or payment, refer to Nuitée's Terms & Conditions (governed by the laws of Ireland) for your rights.

17. Language.

These Terms may be provided in several languages. In case of inconsistency, the English version prevails.
